The High Court in Suva has adjourned the bail revocation hearing of attempted murder accused Saimoni Rokotunidau to October 2 as the court continues to wait for an affidavit explaining his previous absence from court.
Mr Rokotunidau is accused of attempting to murder Police Constable Senoveva Tikoduadua, daughter of Defence Minister Pio Tikoduadua, who was struck by a vehicle while manning a police checkpoint in Laqere, Nasinu, in April.
He also faces a charge of unlawful possession of 0.21 grams of methamphetamine and has pleaded not guilty to both counts.
The matter was called today before Justice Dane Tuiqereqere for a hearing on whether Mr Rokotunidau’s bail should be formally revoked following his failure to attend court on July 29, which led to a bench warrant and his subsequent arrest on August 12.
When questioned by Justice Tuiqereqere today, Mr Rokotunidau confirmed he still has not spoken to his defence lawyer Jerry Dinati.
Mr Rokotunidau presented a letter to the court explaining that his non-appearance on July 29 was due to medical reasons, adding that Mr Dinati possesses the supporting medical evidence. However, Justice Tuiqereqere stated he could not place any weight on the letter alone and emphasised that a formal affidavit from the accused is required.
Justice Tuiqereqere reminded the accused that without the required affidavit, he will remain in custody.
Mr Rokotunidau told the court he will attempt to contact Mr Dinati or engage another lawyer to assist him in preparing and filing the document.
The court adjourned the matter to October 2 to check on the filing of the affidavit.
Mr Rokotunidau remains remanded in custody.
