Union seeks court injunction

A court injunction has been sought in the case of the termination of 285 employees of Air Terminal Services (Fiji) Ltd (ATS) and the recent publication advertisement of jobs by the organisation.

Both applications were called before Justice Mohamed Javed Mansoor at the Employment Relations Tribunal in Lautoka yesterday.

Niveen Padarath, who represented the 285 employees who were terminated from ATS on June 19, said the termination was unlawful.

He said workers wanted to know the basis of the termination.

Mr Padarath added anything to do with an increase or decrease of the workforce would have to be discussed with representatives of the union.

He also asked the court to put a stop to the termination and to the publication of recruitment of workers until the court established whether the termination was lawful or not.

Devanesh Sharma, who appeared on behalf of ATS, said no original summons was filed prior to the filing of the injunction application.

He added there was no evidence to prove that the collective agreement was terminated.

Judge Mansoor ordered Mr Sharma to file his submissions by Friday and Mr Padarath to respond on Monday.

Judge Mansoor is expected to deliver a ruling next week.
