Social Democratic Liberal Party parliamentarian and lawyer Niko Nawaikula appeared before the Independent Legal Services Commission (ILSC) last week after he was charged for professional misconduct.
Mr Nawaikula was charged by the Legal Practitioners Unit (LPU) and he appeared before ILSC commissioner Justice Daniel Goundar.
His hearing date was set for March 15 next year.
LPU lawyer Tui Kilakila told the court that they had finalised and served the proposed agreed facts to Mr Nawaikula’s lawyer.
Mr Kilakila said they would be calling five to six witnesses and relying on a number of documents.
Mr Nawaikula’s counsel said they would be calling two witnesses.
It was alleged Mr Nawaikula did not obtain the necessary approval from members of mataqali Nabukebuke in Namosi to facilitate the formation of a trust deed dated May 6 2009.
It was also alleged that not seeking approval of the clan represented a substantial failure on Mr Nawaikula’s part to reach or maintain a reasonable standard of competence and diligence in the matter.
It was alleged that Mr Nawaikula prepared the mataqali trust deed for the conduct of affairs of the mataqali and for the disbursement of trust monies received from iTaukei Land Trust Board (iTLTB) for the clan.
The hearing is expected to conclude March 16, 2021.
