Code of Conduct Bill has vague, undefined provisions: Karan

THE 2018 Code of Conduct Bill has provisions which are vague and undefined.

This was highlighted by the human rights officer legal Releshni Karan from the United Nations Office of the High Commissioner for Human Rights during their submissions to the Standing Committee on Justice, Law and Human Rights yesterday.

Ms Karan said the danger of vague and undefined provisions was that it was open for abuse by people and offices.

“Section 3 of the Bill says that the power, authority, duty and function of the commission needs to be prescribed under the Bill,” she said.

Ms Karan said neither the Bill nor the schedules provided any clarity on the rules, procedures or limits on the way the commission would function.

The 2013 Constitution, under Section 149 (b) states that a written law shall establish rules, processes and procedures for the implementation of the code of conduct by the accountability and transparency commission.

Ms Karan said the Code of Conduct Bill did not state these things clearly.

“This Bill does not state those things clearly.

“It makes a vague sort of sentence saying that the power, duty and function will be prescribed so we think that this should be re-looked at,” she said.
