Man found guilty for sexual assault of daughter

A LAUTOKA man has been convicted of one count of sexual assault after being found guilty by the High Court in Lautoka.

The man appeared before judge Aruna Aluthge charged with one count of indecent assault, one count of sexual assault and one count of rape.

It is alleged he sexually assaulted his then 12-year-old daughter between 2015 and 2016.

While delivering the judgment, Justice Aluthge informed the court the victim had complained about the incident to her friends and teacher about the accused, who was her biological father.

During the course of the trial, prosecution did not present the medical certificate of the victim and no doctor was called forth to give evidence.

Justice Aluthge said it could be assumed that the prosecution suppressed the medical report because it did not support their (prosecution’s) version.

However, he said, it should be accepted that no medical corroboration was required to bring about a conviction in a rape case. After studying the facts, Justice Aluthge acquitted the accused on the third count.
