The Next Generation Holdings (Fiji) Pte Ltd has sought to overturn the Department of Environment’s decision to reject its proposed Energy to Waste project in Vuda, Lautoka.
In a statement, the company explained it had raised a number of grounds to appeal.
Among the grounds of appeal is the claim the department misinterpreted its powers by saying it could not request further information once the company’s Environmental Impact Assessment (EIA) had been submitted, even though the law expressly allowed it to do so.
“TNG was not afforded procedural fairness. It received no advance notice of the 31 technical questions raised at the review meeting, the review committee’s report was substantially drafted before the consultation meeting with TNG took place, the decision relied on third-party submissions that TNG was not given the opportunity to review or respond to,” the statement said.
“The (Government) decision cited critical information as being absent from TNG’s documents when that information was in fact contained within them.
“TNG’s detailed written responses to the questions raised at the review committee meeting were submitted within five days, but there is no evidence they were considered before the rejection was issued.”
