The Office of the Director of Public Prosecutions has discontinued murder proceedings against two men charged over the death of Police Constable 8012 Peniasi Racagi, citing insufficient evidence.
In a statement this afternoon the Office of the Director of Public Prosecutions confirmed that Keni Salawai and Jope Seniloli appeared before Justice Daniel Goundar at the Suva High Court today.
The pair had been charged with one count of murder.
It was alleged that between February 21 and 22 this year, the two assaulted Constable Racagi, causing injuries that later resulted in his death.
However, the State filed a Nolle Prosequi this morning after determining there was insufficient evidence to proceed with the case.
The two accused men were discharged accordingly.
The ODPP clarified that the discontinuance was made at this stage only and that the State reserves the right to refile the charges should new evidence emerge in the future.
