A MAN has been convicted of sexually assaulting and raping a 14-year-old girl in January this year.
Last week the man was found guilty by Justice Daniel Goundar on one count of sexual assault and one count of rape.
The offences occurred on January 2, two days after the man first met the victim.
Justice Goundar found the victim’s evidence credible and reliable on the facts of the case.
The court heard the girl was alone at home when the man arrived, took her to a bedroom, and raped her.
Justice Goundar rejected defence arguments concerning the victim’s failure to call for help, her delayed disclosure, and inconsistencies.
He said the girl’s failure to scream or physically resist did not amount to consent, noting she was a child who was physically overpowered and frightened.
The case was adjourned for a sentencing hearing.
