High Court stops gravel removal

A GRAVEL extraction company has been ordered to cease operations in Nasou, Nadi, by the High Court in Lautoka.

The court order was issued by Justice Mohammed Ajmeer who ruled in favour of the Tokatoka Namara Trust which sought the court’s assistance.

The trust comprised of members from the mataqali of Namara from Sikituru Village who made the application against SK Davey Ltd from Nadi.

In their application, landowning unit members argued gravel was being extracted from a piece of land that was not agreed upon between the two parties.

They stated that the piece of land called Nasou was used as a farmland for one of its members and not for commercial purposes.

They argued that the land was now being for industrial purposes for financial gain. The Trust sought an injunction from the court to stop gravel being extracted from their land.

In his ruling, Justice Ajmeer imposed an interim injunction be placed on the extraction works until a final determination was made on a few substantive matters on the case.

He said the company and other defendants in the case would be restrained from carrying out any work on the land and they have been ordered not approach any member of the landowning unit.

He added that Trust could sought the assistance of the police if they needed their help.
