A woman who sustained injuries after being hit by a vehicle has been awarded $35,000 by the High Court in Lautoka.
Handra Kanta of Nawaka, Nadi was hit by a rental car driven by Akeneta Liau Nabose on the Nawaka bridge on July 9, 2015.
Ms Kanta had suffered head injuries, fractured collar bone, 4th, 5th and 6th rib fracture and bruises on the lungs which were caused by the rib fracture.
On April 26, Master of the High Court, Mohamed Azhar awarded special damages in sum of $680, $35,000 for pain and suffering and loss of amenities and interest at the rate of 6 per cent on the general damages.
“The plaintiff testified (Ms Kanta) that she was working as a domestic servant at the time of accident,” Master Azhar said.
“She worked as a house girl in four different houses in Nadi.
“She used to work six days in a week from Monday to Saturday. She earned $110 to $120 per week.
“The plaintiff and the witnesses stated that, even though she recovered, she could not do her usual duties and she stopped working as house girl.
“However, she was 60 years old and on her retirement age at the time of the accident.
“Therefore, she will not be eligible to claim for damages under heads of loss of future earning and loss of earning capacity.”
Ms Kanta was also awarded $2000 in court costs.
