The State has discontinued proceedings against two of the three tertiary students charged with the death of Jone Vuinakelo.
State lawyer Tevita Naimila filed a nolle prosequi against Alexander Vatia Leweniqila, 19, and Manoa Vakavunivalu, 19 for a count of murder.
Proceedings against Aisake Lovobalavu, 20, will continue but instead with a manslaughter charge, which he has pleaded not guilty to.
Mr Lovobalavu’s case has also been transferred to Justice Pita Bulamainaivalu.
State lawyer Tevita Naimila said there were partial admissions in which Mr Lovobalavu allegedly admitted in his caution interviewed assaulting the victim because he was touching the girls while they were drinking.
While formally discharging the two men, Justice Goundar reminded them that the state could recharge them in the future with the same offence. Mr Lovobalavu’s bail was extended with his case adjourned to June 25.
