The High Court in Suva today presided over a petition by the Fiji Independent Commission against Corruption (FICAC) appealing the Magistrates Courts’ decision last month in acquitting  former CEO of the then Fiji Commerce Commission Bobby Maharaj on charges of abuse of office.

Mr Maharaj who was charged with one count of abuse of office by FICAC was acquitted by Magistrate Jioji Boseiwaqa on May 11 this year as he had ruled that there was a no case to answer in the matter.

FICAC lawyer  Sera Fatafehi told court that they had filed their petition on time for appeal.

It was earlier alleged that Mr Maharaj did an arbitrary act in abuse of the authority of his office by directing a person, an employee of the Fiji Commerce Commission without conducting an inspection to fill in false information in the Fiji Commerce Commission inspection form to indicate that an inspection was conducted at Rajah’s Food Court and Bakery in Korovou.

The alleged incident took place between March 17, 2012 and December 31, 2012.

The matter has been adjourned to July 30.
