The Legal Aid Commission has filed submissions on the withdrawal of all admitted facts involving former Member of Parliament Peceli Vosanibola.
FICAC had charged Mr Vosanibola with a count of giving false information to a public servant and one of obtaining financial advantage.
It is alleged that between August, 2019, and March, 2020, Mr Vosanibola falsely stated his permanent place of residence was Navuloa Village, Bureta on Ovalau for which he allegedly obtained $19,749.50.
During an appearance on April 9, Legal Aid lawyer Mesake Waqavanua informed the court they would be opposing the agreed facts, which were filed on October 16 last year on the grounds that the accused had chosen to remain silent.
Magistrate Pulekari Low granted the defence 14 days to indicate in their submissions which section of the law would allow them to oppose facts that had already been agreed to by both parties.
She informed the lawyer the criminal registry was not able to locate the submissions after the matter was stood down for the court clerk to assist in locating the defence submissions.
The prosecution was not able to provide a submission on their position of the withdrawal of facts because of admin issues, causing the defence submissions to be received on April 24.
Its request to file a response within seven to 14 days was rejected because enough time had already been allocated for both parties to file their respective documents.
Ms Low ordered the State to file a response before May 2.
Bail for Mr Vosanibola has been extended.
