Call to review limitation

Fiji Trades Union Congress national president Daniel Urai is calling on the Government to review constitutional limitations on freedom of assembly and freedom of speech.

Speaking during the FTUC’s 51st Biennial Delegates Conference in Nadi last week, he said greater progress was needed on the review of both the Constitution and the Electoral Act.

He claimed provisions introduced under the former Political Parties Decree classified trade union officials and staff as public officials, restricting their involvement in politics.

Mr Urai said this requirement forces trade unions to distance themselves from political matters, which he described as unrealistic, and a breach of rights protected under the Constitution.

He also said submissions made during the constitutional review process highlighted concerns over limitations placed on labour rights, including restrictions tied to freedom of speech and assembly.

“Rights are given on one hand but limited on the other through various conditions and interpretations,” he said.

Mr Urai said the Government now faced the responsibility of addressing the interpretation and implications of those constitutional rights.
