Cabinet yesterday was briefed on the Opinion of the Supreme Court issued on 29 August 2025, in response to a reference made under section 91(5) of the 2013 Constitution of the Republic of Fiji.
The Supreme Court opinion, sought by Cabinet earlier this year, provided authoritative interpretation of the constitutional amendment procedures outlined in Chapter 11, as well as related provisions in Part D of Chapter 12. These provisions govern how changes can be made to Fiji’s supreme law, which has been a subject of political and legal debate in recent months.
Following the briefing, Cabinet has established a Subcommittee tasked with charting a clear and responsible path forward for any proposed constitutional amendments.
The Subcommittee will be chaired by Prime Minister Sitiveni Rabuka and will consider the Court’s findings in light of “practical and political considerations.”
The formation of the Subcommittee signals the government’s intention to engage in a careful and consultative process before any amendments to the 2013 Constitution are considered or implemented.
