The High Court in Lautoka on Friday issued yet another order for the Fiji Immigration Department and the Fiji Police Force not to deport a 17-year-old male Grace Road member out of the country.
Juyoung Heo was arrested on Monday while he was travelling in a vehicle on his way to work at the Grace Road farm in Navua.
Justice Mohamed Mackie issued the prohibition orders after receiving an affidavit from Mr Heo’s mother, Sunyoung Jung who works at the Grace Road farm in Vitogo, Lautoka.
“On October 30, 2023 some officers claiming to be from Fiji Immigration Department stopped a Grace Road vehicle, where Juyoung Heo was a passenger, on the way to Grace Road Farm in Navua and arrested Juyoung Heo by forcefully placing him in a motor vehicle registration number MM 279,” Ms Jung deposed in her affidavit.
“Before the arrest, the officers questioned ‘Juyoung’ and when my son answered in the affirmative, the said officers arrested Juyoung Heo. It is evident that the officers came to specifically arrest Juyoung Heo.
“My solicitors have undertaken a Land Transport Authority ownership search of the said vehicle, which is registered to the Fiji Police Force.
“At the time of the arrest of Juyoung Heo I was not present, however, I gather from witnesses account that the officers who arrested Juyoung Heo were in plain clothes.
“I am advised by another member of the Grace Road Group who was with Juyoung Heo at the time of the said arrest that he was not served with any official documents setting out the reasons for his arrest.”
Ms Jung told the court her son was a legal resident of Fiji.
Justice Mackie granted the Writ of Habeas against the Director of Immigration and the Commissioner of Fiji Police and has set a hearing date of November 14.
Last night Grace Road lawyer, Rajesh Gordon, said they were not aware of the whereabouts of their client, Mr Heo.
