The State will not object to bail being granted to a Tamavua-i-Wai resident charged with raping a 25-year-old man while they were both being held as cellmates, along with other detainees, at the Totogo Police Station in Suva.
The 42-year-old appeared before Justice Pita Bulamainaivalu for a bail hearing today in the High Court in Suva.
The man is charged with one count of digital and oral rape, alleged to have been committed on the evening of December 5, 2025.
It is alleged that both men were arrested and remanded at the police station, and that both have pending matters before the Suva Magistrate’s Court.
The allegations stated that while in the cell, the accused instructed other cellmates to look away before sexually assaulting the victim.
A police officer on duty later observed the victim sitting in a corner, where he reportedly informed him of the incident. A report was subsequently lodged.
The man, through his lawyer from the Legal Aid Commission, sought to have his parents, both of whom are over 70 years old, act as his sureties. However, the judge declined the request, ruling that he would not accept them as suitable sureties. The accused was directed to find alternative sureties.
The matter was adjourned to July 24.
