Permanent stay bid decision deferred

FORMER deputy prime minister Manoa Kamikamica will now await the High Court’s ruling on May 5 on whether his Magistrate’s Court proceedings will be permanently stayed or not.

Justice Siainiu Fa’alogo Bull was scheduled to deliver her decision yesterday but advised the parties in court that she required more time to finalise the ruling.

Mr Kamikamica had filed the permanent stay application in relation to criminal charges brought by FICAC. One of the grounds of the permanent stay challenges the validity of the appointment — as acting FICAC Commissioner — of Lavi Rokoika, who sanctioned the charges against Mr Kamikamica.

He is charged with perjury for allegedly stating under oath that he had no involvement in the appointment of former FICAC commissioner Barbara Malimali.

In the alternative, he is charged with giving false information to a public servant over the same alleged statement to the Commission of Inquiry on Ms Malimali’s appointment last year.

Justice Bull will deliver her decision at 2.30pm on May 5.
