Niko’s appeal set for hearing

FORMER parliamentarian Niko Nawaikula’s appeal against the High Court’s decision to strike out his constitution redress application has been fixed for hearing.

Mr Nawaikula had his matter called before judge Justice Pita Bulamainaivalu.

The former SODELPA MP earlier this year sought a constitutional redress in a case involving a magistrate, who he claimed was directed by the late former chief justice Kamal Kumar to transfer the matter to the High Court, which Mr Nawaikula claimed was unfair.

However, his application was unsuccessful, and Justice Bulamainaivalu ordered Mr Nawaikula to pay $2000 to the office of the Attorney-General.

FICAC, as an interested party, was not awarded costs, given the circumstances of the case.

In his ruling, Justice Bulamainaivalu said Mr Nawaikula’s appeal to the Court of Appeal constituted alternative remedies to his constitutional redress action and was an abuse of the court process.

During proceedings, the judge fixed the hearing date to commence on February 14 next year.

The parties have been directed to file their submissions before close of business on January 13.
