The legal action filed by the former commissioner of Fiji Independent Commission Against Corruption (FICAC) challenging her removal from office has been set for Friday June 13.
Barbara Malimali has filed a motion in the High Court seeking leave to apply for a judicial review of the decision to revoke her appointment.
The court document names the President of the Republic of Fiji as the first respondent, the Prime Minister as the Second Respondent, and the Attorney-General as the third respondent.
Ms Malimali is seeking an order from the court that would allow her to formally challenge the government’s decision to remove her from the role, and is also asking for a stay on that decision while the judicial review is underway. According to the notice of motion, the decision to revoke her appointment was made on June 2, 2025, by the President acting on the advice of the Prime Minister.
The case is being brought under Section 5 of the FICAC Act 2007, Section 44 of the Interpretation Act 1967, and Sections 16, 81, 82 and 112 of the 2013 Constitution of the Republic of Fiji.
