Magistrate orders man to abstain from alcohol while in village

A Rakiraki man convicted of drunk and disorderly conduct has been ordered by the Magistrates’ Court to refrain from consuming alcohol as part of his sentence.

Resident Magistrate Timoci Qalinauci imposed the condition after the pleaded guilty to one count of drunk and disorderly under the Minor Offences Act on April 15.

In delivering his ruling, Magistrate Qalinauci stressed the importance of behavioural reform and compliance with the court’s directives.

“I order you to be bound over in the sum of $100 and to be of good behavior for 12 months,” he said.

The court went further, issuing a strict warning regarding alcohol consumption and public conduct.

“Moreover, I order you not to drink alcohol and behave in a disorderly manner at Namara village or you may be charged for disobedience of lawful order under the Crimes Act 2009,” Magistrate Qalinauci stated.

The ruling followed consideration of mitigating factors, including the accused’s status as a first-time offender and his early guilty plea.

“The mitigating factors are you being a first offender and remorseful of your action… Your early guilty plea has saved the Court and Prosecution’s time,” he noted.

Magistrate Qalinauci said he was satisfied that the accused understood the charge and had admitted to the facts of the case.

“I find you guilty as charged and convict you accordingly,” he said.

The court discharged bail conditions and advised the accused he has 28 days to appeal the decision in the High Court.
