INMATE Imran Khan has filed an urgent High Court application seeking to stay State forfeiture proceedings and preserve assets subject to an active appeal.
Khan, currently serving a prison sentence, alongside second appellant Deborah Kim, filed an affidavit on August 21 requesting an order to halt further forfeiture actions by the Director of Public Prosecutions (DPP) pending their Court of Appeal case.
The application stems from a February 20, 2026, judgment by Justice Senileba Waqainabete-Levaci. The court issued an unexplained wealth declaration and permanent restraint orders over $404,840.34 in a Bred Bank account under Reliable Computers, a Valelevu residential property, and four vehicles.
According to the application, Khan states that while his lawyer only learned of the DPP’s new forfeiture application through media reports, finalising forfeiture before their appeal is heard would render their legal challenge meaningless.
The appellants argue the original ruling erred by relying on speculative opinion evidence without cross-examination and failing to conduct adequate financial analysis.
Khan assured the court they are not seeking the release of the assets, offering to maintain current restraint orders to preserve status quo until the appeal concludes.
