Fiji’s justice system is grappling with a significant case backlog, with the Chief Registrar revealing that between 2009 and 2026, authorities received 4280 total complaint against lawyers of which approximately 2771 have been disposed.

Speaking at the 2026 Fiji Law Society Convention in Nadi during the “Rules, Roadmap and Resolution” session, Tomasi Bainivalu revealed that mediation success rates stand at 54 per cent, demonstrating the effectiveness of Alternative Dispute Resolution mechanisms.

However, he acknowledged that a significant number of cases remain pending and blocked the final outcome.

The Chief Registrar emphasised the figures underscore the need for enhanced case management powers, earlier identification of issues in dispute, and greater encouragement of ADR processes.

He said that reforms should enable administrations to identify matters suitable for mediation at an early stage, significantly reducing delays.

Mr Bainivalu also highlighted the importance of quality accreditation for mediators, stating that mediation depends on the quality and competency of mediators, appropriate accreditation and training frameworks remain critical to ensure consistency.

The statistics reveal both progress and challenges facing Fiji’s civil justice system as it continues its reform journey toward more efficient dispute resolution.
