Court dismisses application

THE Appeals Court has dismissed Veronica Malani’s application to appeal against the decision of the late chief justice, Kamal Kumar, delivered on September 10, 2021, regarding an alleged bombing attack on her home in 1987.

Ms Malani had her case called earlier this month before Justice Chandana Prematilaka for a ruling on her application.

She had sought a judicial review on the High Court’s decision refusing an ealier application to overturn Justice Kumar’s ruling.

In an earlier decision, the High Court, citing insufficient evidence, had affirmed the Director of Public Prosecutions’ decision not to prosecute former attorney-general Aiyaz Sayed-Khaiyum, who was alleged to have been involved in a bombing of Ms Malani’s home in 1987 when she was 14 years old.

She further alleged the blast injured her and her mother.

The DPP had declined to bring charges against Mr Sayed-Khaiyum on the basis of insufficient credible and reliable evidence to support criminal charges.

Justice Prematilaka was of the view that Ms Malani’s grounds of appeal did not have a realistic prospect of success in appeal, nor did they raise any matters of public interest or importance, and neither did they relate to any novel legal issues. Therefore, it was not a fit case to grant leave to appeal on either of the grounds.
