Court acquits man of rape charges

High Court Judge, Justice Sunil Sharma acquitted a man of two counts of rape on September 15.

The accused was initially charged with committing the alleged offences between January 1, 2019 to December 31 of the same year.

The court heard that the complainant testified that the school matron pressured her into making the allegations against her uncle, the accused, and that he did not do anything to her as alleged.

Justice Sharma said upon cross-examination the complainant said she understood the meaning of the oath and that she had not been coerced into saying what she told the court.

She also told the court that whatever she had said was of her free will.

“The state counsel closed its case after calling the complainant,” Justice Sharma said.

“The defence counsel made an application for no case to answer.

“The test at this stage of the trial is whether there is any evidence in respect of all the elements of the offences the accused is charged with.”

Justice Sharma said the court was satisfied that there was no evidence against the accused.

“In the circumstances, this court has no option but to uphold the application for no case to answer and acquit the accused.”

Justice Sharma acquitted the accused accordingly.
