THE High Court in Suva has put aside two days in June to hear former Maritime Safety Authority of Fiji chief executive Joweli Cawaki’s application for leave to seek judicial review of his termination.
Mr Cawaki’s matter was called before Justice Savenaca Banuve yesterday for mention.
The five respondents in the matter are the Maritime Safety Authority of Fiji (MSAF), the MSAF Board of Directors, the Attorney-General, the Minister for Transport, and the Minister for Public Enterprises.
According to court documents, Mr Cawaki was issued a termination letter while he was suspended pending an investigation into alleged misconduct concerning the Captain Inoke vessel.
He claimed due process was not followed in his dismissal and that the decision failed to comply with the principles of natural justice including the failure to disclose allegations, evidence or investigation findings, and the denial of his right to be heard.
Mr Cawaki is seeking orders to quash the termination, declare the decision unlawful, and obtain other reliefs.
The hearing is scheduled to commence on June 9 at 9.30am, with lawyer Jagath Karunaratne appearing for Mr Cawaki.
