A man has been acquitted by the court after the State was unable to provide valid evidence to support a charge of theft.

Jiwa Cewai appeared before Magistrate Seini Puamau yesterday.

The prosecution said proceedings should not continue because some State witnesses were on other duties.

The defence objected to any adjournment saying Mr Cewa had appeared 19 times and deserved to have the matter heard as soon as possible.

Ms Puamau was told the State was relying on CCTV footage as evidence however, the defence lawyer argued the footage showed no link to the case.

Adjournment was denied and the trial proceeded with the State summoning the complainant, Pradeep Chand, who said his only memory of the incident was realising his wallet containing $260 was missing after he had boarded a bus.

Mr Cewai was then acquitted.
