The iTaukei Land Trust Board (TLTB) states no action will be taken to arbitrarily remove any of the residents of the Toko lease in Tavua nor does it intend to dispossess residents of their occupation of the land.
TLTB made the comments after the Ba High Court issued an interim injunction for orders restraining TLTB from surrendering, cancelling or otherwise dealing with the Toko leases or subleases.
“The proceedings seek to determine, among other things, the question of whether the Board has the powers to unilaterally surrender, cancel, or deal with the land without the consent of the sublessees and the occupants,” states TLTB.
“It is not uncommon for the High Court to order an injunction temporarily to allow parties to file their respective affidavits, for the interim injunction application to be heard, and for the Court to determine whether to order an interim injunction.”
“Such orders, if granted, are intended to maintain the status quo and preserve the rights of the parties until the substantive action is finally determined.”
TLTB adds that it has always endeavoured to work collaboratively with the landowners and tenants to arrive at an equitable arrangement that benefits both the landowners and tenants.
“The matter is currently before the Courts and therefore remains sub judice.”
