Acting Director of Public Prosecutions David Toganivalu yesterday filed a nolle prosequi against two men who were charged with sending $35 million worth of cocaine to Australia.

Marc Winston and Shaneil Suresh Autar were alleged to have facilitated the exportation of 34 parcels of cocaine on October 8, 2019, to Australia.

The duo walked out of the High Court in Lautoka as free men after the nolle prosequi was filed.

The trial was set to start before Justice Riyaz Hamza yesterday morning when the DPP wanted to file additional disclosures in relation to exhibits.

Lawyers for Mr Autar and Winston objected to this and Justice Hamza stood down the matter to yesterday afternoon.

The DPP came back to file the nolle prosequi. Dutch National Marc Winston, Shaneil Autar, Roshneel Kumar and Pravishek Narayan were initially charged with one count each of unlawful possession and supply of illicit drugs.

Mr Winston, 51, Mr Autar, 35, Mr Kumar, 24, and Mr Narayan, 21, were accused of dealing with the transfer, transport and supply of 39.36 kg of cocaine between Lautoka and Nadi on October 7.

The next day Mr Winston and Mr Autar were alleged to have without lawful authority facilitated the exportation of 34 parcels of cocaine weighing approximately 39.36 kg.

Mr Kumar and Mr Narayan were earlier granted immunity by the Director of Public Prosecutions.
