The High Court in Lautoka will today hear a constitutional redress case Nadi lawyer Rajesh Gordon has filed against the chief registrar.
He is alleging the chief registrar is now pursuing a complaint that was lodged in 2017 against him which is contrary to the Constitution of Fiji and has been dealt in a timely manner.
“The purported complaint by Vijendra Mani was received by the first respondent on September 15, 2017,” Mr Gordon stated in his motion to the court.
“More than five years later the first respondent chose to write to the applicant vide his letters/notices dated December 19, 2022 emailed to the applicant on December 20, 2022, referring to the applicant, for the first time, the substance of the purported complaint.
“Section 2(3) of the Constitution of the Republic of Fiji requires the first respondent to uphold and respect the Constitution of the Republic of Fiji and to fulfil all the obligations imposed by the Constitution of the Republic of Fiji,” the motion stated.
“The applicant has an entrenched constitutional right that the first respondent carry out his duties, obligations and statutory function and powers, in so far as they affect the applicant, in a lawful, rational, proportionate, procedurally fair, and reasonably prompt manner.
“The purported complaint of Vijendra Mani makes no mention of the applicant nor any complaint against any action or inaction by the applicant.”
The constitutional redress case will be called before Justice Lyone Seneviratne.
