Appeals against the High Court conviction and sentence of Canadian Fijian drug trafficker Joshua Rahman were called in the Court of Appeal at Veiuto last week.
Joshua Rahman was convicted for being in possession 39.5 kilograms of cocaine in March 2021. He was sentenced in October.
The Director of Public Prosecutions (DPP) is appealing the 23 years sentence handed down to Rahman by High Court judge Justice Daniel Goundar.
The DPP filed the appeal on the ground that the court had not given sufficient regard to the guideline judgment in drug offences in State vs Abourisk (2019), resulting in a manifestly lenient sentence, which did not reflect the degree of criminality in the case.
Rahman is also appealing his conviction and sentence. Court of Appeal judge Justice Chandana Prematilaka heard the parties had filed all submissions.
The matter will be called for hearing on March 13, 2023.
