Deadline given to the State

THE Office of the Solicitor-General has until the end of this month to reply to the submissions made by suspended parliamentarian, Ratu Naiqama Lalabalavu’s lawyers.

Ratu Naiqama is seeking declarations from the High Court that the Speaker contravened his various Constitutional Bill of Rights as a Representative of Parliament under chapter two of the Constitution by suspending his membership of Parliament and withholding his pay.

The case was called on Tuesday before Chief Justice Anthony Gates.

Simione Valenitabua of Toganivalu Valenitabua lawyers appeared for Ratu Naiqama while the office of the Solicitor-General was represented by Robyn-Ann Mani.

Justice Gates has ordered that the office of the Solicitor-General file its submissions by December 31.

Any reply by Toganivalu Valenitabua lawyers are to be made by January 14, 2016.

The agreed bundle of authorities is to be filed as well by January 14.

The matter has been adjourned to January 18, 2016 to check compliance before Justice Gates.

Meanwhile, the hearing for the strike out and substantive applications relating to the case are scheduled for January 21, 2016.
