Inconsistent evidence in rape case

A MAN who was alleged to have raped a four-year-old girl in 2012 was acquitted by the High Court in Suva on Friday last week.

In his judgment, High Court judge Justice Vinsent Perera said he concurred with the unanimous opinion of the assessors that the accused was not guilty of the first count of rape and the alternative count of sexual assault.

He said there was no direct evidence of the act.

Justice Perera said there were many inconsistencies in the evidence given by the complainant.

Given the inconsistencies, he said, he was compelled to form the view that the complainant’s evidence was unreliable.
