The Supreme Court of Fiji will livestream the significant oral hearing from 18 to 22 August 2025, addressing five critical questions referred by the Cabinet concerning amendments to the 2013 Constitution.

The questions include the legality and validity of the 1997 Constitution.

The livestreaming ensures public access to a landmark case that could shape Fiji’s constitutional framework.

The Office of the Attorney-General said initiated proceedings under section 91(5) of the 2013 Constitution by filing an Originating Motion, Reference, and supporting affidavit.

The questions, referred by the Cabinet, focus on amendment provisions, with the fifth question specifically probing the legal standing of the 1997 Constitution.

During a direction hearing held yesterday, Solicitor-General Ropate Green updated the Supreme Court on the State’s submissions, including a summary of arguments and a supplementary statement of constitutional facts.

Intervenors also clarified their positions on their submissions.

The Court announced it will issue a memorandum of questions by Friday, 26 July 2025, for parties to address in their responses, due by 8 August 2025.

A final directions hearing is scheduled for 2:30 pm on 8 August 2025 to review these submissions.

The livestreamed oral hearing, set for 18–22 August 2025, will allow the public to follow the proceedings in real-time, reflecting the Court’s commitment to transparency.

The Supreme Court is expected to deliver its judgment on 5 September 2025, potentially setting a precedent for Fiji’s constitutional law.
