Supreme Court to hear landmark Constitutional reference case from today

The Supreme Court of Fiji will today commence hearing a major constitutional reference brought by the Cabinet concerning the interpretation and application of sections 159 and 160 of the Constitution of the Republic of Fiji.

The full bench, presided over by Chief Justice Salesi Temo, includes Justices Terence Arnold, Madam Justice Lowell Goddard, Justice William Young, Justice Robert French, and Justice Isikeli Mataitoga.

The matter is scheduled for a full-day hearing whole of this week.

The Attorney-General’s Chambers is representing the State.

Nine interveners have joined the matter and will make submission which include major political parties and organizations.

The People’s Alliance Party will be represented by Redwood Law, National Federation Party (Munro Leys), Social Democratic Liberal Party – SODELPA (Dayal & Associates), Fiji Labour Party (Karunaratne Lawyers), Unity Fiji Party (Ravono & Raikaci Law), Fiji Human Rights & Anti-Discrimination Commission (in-house counsel), Fiji Law Society (Howards Lawyers), Inia Seruiratu (KS Law) and Ioane Naivalurua (Rokoika & Vakalalabure Lawyers / Triton Law).

The Supreme Court had announced the proceedings will be livestreamed to allow the public to follow the proceedings in real-time, reflecting the Court’s commitment to transparency.

The Supreme Court is expected to deliver its judgment on 5 September 2025, potentially setting a precedent for Fiji’s constitutional law.
