Supreme Court appeal: ODPP reviews decision to quash conviction

The Office of the Director of Public Prosecutions says it is considering the possibility of a Supreme Court appeal against the Fiji Court of Appeal decision setting aside the drugs-related conviction of Fiji-Canadian national Joshua Aziz Rahman.

In a statement yesterday, the ODPP said it is reviewing the decision by the Court of Appeal to quash Mr Rahman’s conviction, set aside his sentence and ordering a retrial.

Mr Rahman had been charged with the unlawful possession of 39.5 kilograms of cocaine discovered at his Caubati home in Nasinu in 2019.

The drugs were found in the bedroom of his father, who was overseas at the time of the search.

In 2021, he was convicted by the High Court and sentenced to 23 years’ imprisonment with a non-parole period of 14 years.

Meanwhile, the ODPP has stated that while members of the public are entitled to debate the outcome of court decisions, they should refrain from making unnecessary comments or personal attacks against the judiciary while the matter remains before the courts.

“It is important that the criminal justice system is allowed to proceed in accordance with the law and due process,” the office said.
