Stay of proceedings planned

AN APPLICATION will be made to the High Court for a permanent stay against former trade minister Manoa Kamikamica’s criminal proceedings in the lower court.

His lawyer Wylie Clarke told Magistrate Charles Ratakele yesterday that FICAC’s failure to respond on Thursday suggested the prosecution did not intend to withdraw the charges.

Mr Kamikamica faces a count of perjury for allegedly knowingly making a false statement under oath, claiming he had nothing to do with the appointment of Barbra Malimali as FICAC Commissioner.

In the alternative charge, he faces a count of giving false information to a public servant for allegedly providing the same false information to a Commissioner of Inquiry.

In the meantime, he has been released on a $10,000 non-cash bail bond with standard bail conditions.

His sureties, Judy Compain and Moala Nata, assured the court the accused would appear whenever his case is called.

Mr Clarke has sought a 28-day adjournment to update Mr Ratakele on his permanent stay application.

The case will be recalled on November 28.
