The State’s appeal in the case of convicted schoolteacher Kishore Kumar, who pleaded guilty to making false pornographic claims against Assistant Foreign Affairs Minister Lenora Qereqeretabua, was heard on July 18.
Mr Kumar was not present when the case was called before Justice Siainiu Fa’alogo Bull in the High Court in Suva.
In April, Mr Kumar had his 32-month jail sentence suspended for five years, but was admitted into psychiatric care at the St Giles Hospital after his release from custody.
While in custody, he was registered as an outpatient and assigned a case manager to ensure compliance with medication and regular follow-up.
Kumar was charged with six counts of causing harm by posting electronic communication and a count of criminal intimidation.
Assistant Director of Public Prosecutions Laisani Tabuakuro said the State is appealing against the sentence only, and since this is the first case involving the Online Safety Commission, it is seeking a guideline judgment to assist other cybercrime offences coming to court.
Ms Tabuakuro said it would be best for Kumar to serve his sentence in jail to ensure he receives his medication before being released.
The case was adjourned to August 1.
