Samisoni opposes strike out application

John Samisoni opposed the State’s application to strike out his constitutional redress case.

His lawyer, Simione Valenitabua, made this known in the High Court in Suva last week, when the matter was called before Chief Justice Kamal Kumar.

Mr Valenitabua said that when the case was last called, he and his client were tasked to consider the strike-out application and after consideration, they had opposed it.

He said the counsels for all parties to the case had liaised on the matter.

Devanesh Sharma, counsel for the Minister for Employment, Minister for Health and the Attorney-General in the matter, said the State would be relying on the evidence in the affidavit sworn by John Samisoni in the matter to strike out his constitutional redress case.

Mr Sharma said they did not need to file any other evidence in support of their case as their target was in the reliefs that Mr Samisoni sought in his application for constitutional redress and, as such, they would rely on his sworn affidavit.

Mr Samisoni filed the case against Corporate Management Services Limited (CMSL) trading as The Hot Bread Kitchen, the Minister for Employment, Minister for Health and the A-G, following his dismissal as the managing director of CMSL after he refused to be vaccinated against COVID-19.

The matter will be called again on February 8 for hearing.
