Rabuka appeals Malimali ruling

PRIME Minister Sitiveni Rabuka has filed an appeal seeking to overturn a High Court ruling that found the dismissal of former Fiji Independent Commission Against Corruption commissioner Barbara Malimali to be unlawful.

The civil appeal listed as No 021 of 2026 was filed at the Fiji Court of Appeal yesterday.

There are a total of 11 grounds challenging Justice Dane Tuiqereqere’s February 2 judgment, which had upheld Ms Malimali’s judicial review in HBJ 05 of 2025.

Some of the orders sought by Mr Rabuka are that Lavi Rokoika continue serving as Acting FICAC Commissioner until the appeal is decided.

They also include a declaration that Ms Malimali’s appointment was vitiated by pre-appointment taint and she held neither de jure nor de facto status.

Earlier this year, Mr Rabuka said he would consider resigning as Prime Minister if the appeal fails.
