Musa faces civil action in court

A civil claim against businessman Aiyaz Mohammed Musa Umarji is currently before the High Court in Suva.

In this matter, the plaintiffs — Superdrug Pharmacy Pte Ltd and Nands Pharmacy Pte Ltd — filed proceedings last year against Mr Umarji, his wife Zaheera Cassim, and Hyperchem Pharmacy Pte Ltd.

According to their statement of claim, Mr Umarji was the CEO of Superdrug Pharmacy while Ms Cassim is the sole shareholder and director of Hyperchem, which is engaged in the distribution and sale of pharmaceutical, healthcare and beauty products, and operates several pharmacies.

It states that Superdrug employed Mr Umarji under a contract as CEO beginning in December 2019 for a term of five years and he stepped down from the position in March of 2021.

The plaintiffs allege that during his time as CEO, Mr Umarji was responsible for the company’s financial affairs and for securing the purchase of pharmaceutical products.

They further claim that he wrongfully and without lawful authority transferred Superdrug’s head office administration to Hyperchem’s Lautoka office.

As a result, the plaintiffs say their accounts were handled by Mr Umarji’s own employees, through whom the defendants allegedly took orders and supplied to the plaintiffs on Mr Umarji’s orders.

The plaintiffs, represented by Sherani & Co, brought causes of action for conspiracy to defraud against all three defendants, and breach of contract and breach of fiduciary duty against Mr Umarji.

In court yesterday, Suva lawyer Devanesh Sharma, representing both Hyperchem and Ms Cassim, filed a summons for an injunction against the plaintiffs from selling Nands Mall in Nabua, which the plaintiffs operate from.

The plaintiffs have sought time to respond to the interlocutory application by January 7.

Justice Waleen George will hear the application on February 20, 2026.
