Uncontrollable crying, loss of appetite, and a decline in energy and motivation were among the severe emotional impacts suffered by Minister for Information Lynda Tabuya following an online abuse incident heard in the High Court in Suva.

The details emerged in the sentencing by Justice Daniel Goundar, where the accused, Lui Bale Vuibureta, pleaded guilty to one count of causing harm by posting an electronic communication under the Online Safety Act 2018.

The court heard that the abuse, which was broadcast live and later circulated widely, caused significant psychological distress to Ms Tabuya, affecting both her personal wellbeing and professional life.

In her victim impact statement, she described the experience as deeply humiliating and damaging to her reputation as a woman, mother and public servant.

The Minister said the incident left her embarrassed to appear in public and led to her withdrawing from public engagement, while her family also suffered distress witnessing the impact of the abuse.

Justice Goundar noted that while public figures can expect criticism, the nature of the offending in this case went far beyond acceptable limits.

The court found that the accused used extremely vulgar and degrading language intended to humiliate the Minister, and that the content reached a large audience, amplifying the harm caused.

Justice Goundar stressed that such conduct carries serious consequences, particularly in Fiji where public humiliation and sexualised insults carry strong social stigma.

He said the case serves as a clear reminder that online platforms must not be used to abuse or degrade others.
