MAGISTRATE Seini Puamau has questioned the police prosecution on the basis of their case regarding a murder charge against 28-year-old Rupeni Tokabe.
Mr Tokabe appeared in the Lautoka Magistrate’s Court on July 30 charged with causing the death of his 25-yearold wife.
The incident took place during a domestic dispute at their home at Kaleli Settlement in Lautoka, on July 28.
Prosecutor Sergeant Anlesh Kumar told the court that Balekana’s postmortem examination report was not ready.
Magistrate Puamau said there had to be a logical reason for the report not being ready. She then questioned the prosecution on the basis of the charge, saying it was concerning to file a murder charge without a postmortem examination report.
Corporal Nacanieli Lomani told the court Balekana’s death certificate listed blunt force trauma as the cause of death.
Magistrate Puamau told the prosecution to ensure the report and the caution interview transcript were ready for the High Court.
The police prosecution objected to bail because the offence was an indictable one.
Mr Tokabe was further remanded in custody, and the matter was transferred to the High Court in Lautoka where it will be called on August 13.
