Lawyer for accused three wants full disclosures

DEFENCE lawyer Iqbal Khan yesterday informed the High Court in Lautoka that his clients would  not be taking a plea unless they received full disclosures from the State.

Mr Khan is representing Justin Ho, Louie Frank Penijamini Logaivau and David Otto Heritage on charges relating to the 4.1 tonnes of methamphetamine seizure in Nadi.

They are part of the 10 individuals charged with unlawful importation of illicit drugs, unlawful possession of illicit drugs, and possession of property suspected of being proceeds of crime relating to the importation and transportation of illicit substances.

Mr Khan informed Justice Aruna Aluthge they needed clear photographs of the alleged crime scene.

Similar sentiments were echoed by another defence lawyer Edwin Wainiqolo who said the disclosures were a blur and could not interpret what was in the photographs.

The defendants had also asked for five of the caution interviews to be disclosed.

Justice Aluthge pointed out that it had taken the State five months to file the disclosures.

In response, State lawyers asked for 21 days to file the statements.

Meanwhile, Mr Khan has objected to an application by the Office of the Directoir of Public Prosecutions to destroy the drugs because of the non-disclosures from the State.

The defendants have been given 14 days to respond to the affidavit of the applicant on the instruction to destroy the drugs.

The matter has been adjourned July 1 while the plea will be called again on July 15.

An application for a bail hearing for one of the accused, Jale Aukerea, was also withdrawn yesterday.
