THE High Court has set a hearing date for a plaintiff’s recusal application against a lawyer representing Charan Jeath Singh, the Minister for Multi-Ethnic Affairs and Sugar Industry.
This civil action alleges the minister, being a shareholder of two companies, had removed one of their two founding directors and appointed himself and the plaintiff as directors.
The plaintiff, Jagjeet Singh, has alleged the minister convened and chaired an extraordinary meeting on September 30, 2012, and January 6, 2013, unlawfully without complying with the companies articles of association.
Mr Singh claims that at the time of the meeting — when he was out of the country from September 28 to October 6 in 2012 — the minister allegedly forged his signature.
On February 19, 2014, it is alleged that without any shareholder meeting or resolution, the minister appointed his wife, Swaran Nandita Singh, as a director of both companies.
A year later the minister and his wife allegedly borrowed $2,520,000 from a bank without any meeting or consultations with the companies shareholders.
Jagjeet Singh said the appointments and removal of the founding director were in breach of the articles of association of both companies. The minister, also without authority, is alleged to have colluded with lawyer Hemendra Nagin who is also a defendant in these proceedings. It is alleged that since his appointment as the company’s solicitor, he aided and abetted the minister and his wife in their activities.
Mr Singh claimed the minister’s actions caused a massive loss and exposed the shareholders of the company to losing company property.
At yesterday’s proceedings before Justice Anjala Wati, the hearing was adjourned to September 30 to hear the recusal application against Mr Nagin and his firm from representing the defendants.
