Image-based abuse on the rise

Online Safety Commissioner Filipe Batiwale says there is a growing concern about image-based abuse.

He revealed this during the Pacific Cyber Week Conference held at Denarau in Nadi this week.

“Under our Online Safety Act there is two offences in the Act, “Mr Batiwale said.

“The first being a general cyber bullying offence which requires an intention to post in electronic communication with the intention to cause harm to another person.

“The second offence is the image-based abuse — the unlawful sharing of any intimate photos without the consent of the party affected.

“So for a person to report a complaint to the commission they need to be the targeted person of the electronic communication which is likely to cause harm, or subjected person for an electronic communication or of an electronic communication.”

Mr Batiwale said the existing legal framework was “very rigid”.
