The application for recusal by alleged drug trafficking accused Justin Ho has been refused by the High Court in Lautoka. The ruling was delivered by Justice Aruna Aluthge this morning.
Mr Ho had applied to have Justice Aluthge step down from hearing his case in the 4.1 tonnes of meth case alleging he was being treated unfairly especially in instances where he was applying for bail.
In his ruling, Justice Aluthge said an accused could make any number of application but the Court was entitled to refuse the application if it saw the grounds as frivolous. . He said as for the $15,000 cash bail imposed on Mr Ho had not impeded his release.
He added according to the Bail Act, cash bail for important cases Justice Aluthge responded to the 12 grounds of recusal in Mr Ho’s application this morning during his almost one hour ruling. Pre-trial conference discussions on the alleged drug trafficking case were also held before Justice Aluthge today.
