High Court orders psychiatric evaluation for 18-year-old student

THE High Court has ordered that a Suva sixth-former accused of killing a man in his 20s in an apartment building receive psychiatric evaluation.

Rihaal Kumar,18, was also refused bail today by Justice Daniel Goundar after a bail hearing.

State lawyer Bhavna Kantharia sought and was granted her application for psychiatric evaluation in court this morning.

The teenager allegedly murdered Sharuf Shaakir Khan in an apartment complex on Waimanu Road on July 7.

Ms Kantharia also informed the court that the accused has been terminated from school, and therefore,  will not be able to return.

His lawyers, Mark Anthony, and Robert Bancod from Millbrook Hills Law, had submitted to the court that Mr Kumar was entitled to bail, given he is a first offender with no history of absconding and, as such, will appear in court to answer to the charge laid against him.

However, the judge has decided to deny bail. A written ruling will be issued to parties within 24 hours.

Mr Anthony also indicated that he still has not received the disclosures from the state despite requesting them since last week.

Ms Kantharia, in response, said she is yet to receive the transcript of the Video Recorded Interview and the postmortem report from authorities.

Mr Kumar will take his plea on August 29.
