Court defers judgment of FICAC’s appeal

The Anti-Corruption Division of the High Court in Suva deferred judgment of the Fiji Independent Commission Against Corruption’s (FICAC) appeal of the Magistrates Courts acquittal of former Fiji Commerce Commission (FCC) CEO Bobby Maharaj on abuse of office charges.

The matter was called before High Court judge Justice Dr Thushara Kumarage last week.

It was listed for judgment, but Justice Kumarage said it was not ready and was of academic importance.

Mr Maharaj was charged with one count of abuse of office for allegedly directing an FCC employee to fill in false information without inspecting a food court and bakery business in Korovou, Tailevu, between March and December 2012.

It was also alleged that a verbal warning was issued against the trader as a result.

The Magistrates Court in May 2020 ruled that there was no credible evidence to support the charge and Mr Maharaj was acquitted.

The appeal will be called again for judgment on April 28.
