THE Ba Magistrate’s Court has convicted a man for indecently assaulting his 13-year-old niece in 2022.
Magistrate Namrata Mishra found the man guilty on a count each of indecently annoying any person and an indecent assault committed on May 4 and 5, 2022.
According to the victim, her uncle indecently assaulted her when she was changing her clothes before telling her to massage his stomach. He told her not to tell anyone what he had done to her.
The following day, she broke down and told her mother what the man had done, after her mother had a troubling vision that something shameful had occurred in the family.
At the time of the offence, the man’s children had gone to the river for a swim, while the victim’s parents were still at work.
In her determination, Ms Mishra found that the prosecution had discharged its burden in proving all the elements for the criminal charges as per her February 27 judgment.
